By accessing or using Ovela's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms apply to all users of the platform, including patients, healthcare providers, and partners.
2. Services Description
Ovela provides medical tourism facilitation services, connecting international patients with healthcare providers in Pakistan. Our services include, but are not limited to: medical consultation coordination, hospital and doctor recommendations, treatment planning assistance, travel and accommodation support, and medical record management. We act as facilitators and do not directly provide medical services.
3. Medical Disclaimer
Ovela is not a medical provider and does not offer medical advice, diagnosis, or treatment. All medical services are provided by independent, licensed healthcare providers. We do not guarantee specific medical outcomes and strongly recommend consulting with qualified healthcare professionals for medical decisions. The relationship between you and your healthcare provider is independent of our services.
4. User Responsibilities
Users must provide accurate and complete information, including medical history and personal details. You are responsible for maintaining the confidentiality of your account credentials, complying with all applicable laws in your country of residence and treatment destination, obtaining necessary travel documents and medical clearances, and following all medical advice and treatment protocols provided by healthcare professionals.
5. Payment Terms
Payment terms vary based on the specific services and healthcare providers selected. Prices quoted are estimates and may vary based on individual medical needs. Payment obligations are between you and the healthcare provider, though we may facilitate payment processing. Refund policies are subject to individual provider terms and conditions. All prices are listed in USD unless otherwise specified.
6. Limitation of Liability
To the fullest extent permitted by law, Ovela shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services, medical outcomes or complications, acts or omissions of healthcare providers, travel-related issues or complications, or loss of data or unauthorized access to your information.
7. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy. By using Ovela, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. We implement industry-standard security measures to protect your personal and medical information.
8. Intellectual Property
All content on the Ovela platform, including text, graphics, logos, images, and software, is the property of Ovela or its licensors and is protected by international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
9. Termination
We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved through binding arbitration in Islamabad, Pakistan.
Medical Tourism Specific Terms
Travel Risks
Medical tourism involves travel, which carries inherent risks. Ovela is not responsible for travel delays, cancellations, or complications that may affect your medical treatment schedule.
Follow-up Care
You are responsible for arranging and attending follow-up care in your home country. Ovela can facilitate communication with your treating physicians but cannot guarantee the availability of specific follow-up services.
Insurance Coverage
Many insurance policies do not cover medical tourism. You are responsible for verifying your insurance coverage and understanding your financial obligations.
Medical Records
You authorize Ovela to facilitate the transfer of your medical records between healthcare providers as necessary for your treatment. You retain ownership of your medical records.
Dispute Resolution
We are committed to resolving disputes fairly and efficiently. Any dispute arising from or relating to these Terms of Service or our services shall be resolved through the following process:
- Informal Resolution: Contact our customer service team to attempt informal resolution.
- Mediation: If informal resolution fails, parties agree to attempt mediation before proceeding to arbitration.
- Arbitration: Final resolution through binding arbitration in Islamabad, Pakistan, under the rules of the Pakistan Arbitration Act.
